Hmmm, a tricky one. I think you might be able to dodge the public disclosure rule by not disclosing how the pieces are encoded in the software, possibly going as far as only including them encrypted in a pre-compiled library. You're right though, it's a very fine line, but I think you can technically distribute something without disclosing to the public what it contains.

I have reported Mr. Warren to FaceBook's administrators for having posted a message saying that he intends unlawfully to encode the pieces of the Eternity II puzzle and then to distribute it widely on the internet. Any such encoding, in any form, would be a breach of my copyright and, if it occurred, would lead to action for recovery of damages. I have asked him to apologize for having proposed to breach my copyright. I have asked him to undertake not to make this or any suchlike proposal again, and not to breach my copyright by copying or distributing the pieces of Eternity II in any form or medium. In a separate posting, which I have also reported, Mr. Warren mentioned that he intended to encode the pieces in such a way as, in effect, to conceal the fact that he had encoded them. Any such conduct would constitute the criminal offence of fraud. I regret having had to assert my copyright in this way, but many jobs worldwide depend on my inventions, and I have a moral as well as a contractual duty to protect them - Monckton of Brenchley
